Arganica Terms & Conditions
An Arganica membership provides you with access to the best local, organic, and artisanal foods the mid-Atlantic has to offer via weekly home delivery. By registering for an Arganica membership, you agree to be bound to the following terms and conditions ("ARGANICA TERMS AND CONDITIONS."), which apply to all versions of Arganica membership, whether they be the Healthy Workplace, customer referral, partnered, previous 365- and regular memberships, or gift subscriptions. Arganica reserves the right to change, update and revise the ARGANICA TERMS AND CONDITIONS from time to time, at its sole discretion. Any changes to membership ARGANICA TERMS AND CONDITIONS will be communicated to all Arganica members as they occur.

Arganica reserves the right to alter one or more of the Arganica Policies at any time, with emailed notice to members.

REQUIREMENTS: To purchase an Arganica Membership, you must be:

Legally capable of entering into a binding contract; and

Able to provide valid registration information, a valid payment method, and other payment information at the time of purchase.

ACTIVATION: To activate your Arganica membership, you must completely fill out the member profile page and “accept” ARGANICA TERMS AND CONDITIONS

SUBSCRIPTION: The Arganica Membership is a monthly subscription. The day that you register for and purchase your Arganica Membership ("Activation Date") is the first day of your monthly billing cycle. Your Subscription will be automatically renewed each month unless you “opt-out” accordance with the terms of your Arganica Membership (see #5 below).

AUTOMATED BILLING: By purchasing an Arganica Membership, you authorize Arganica to charge a monthly Arganica Membership fee amount to the payment method that you provided on your member profile page. The subscription fee is exclusive of any applicable Federal, state or municipal taxes or duties. Arganica may change the subscription fee amount upon 30 days' prior notice to you via email. Any changes to the subscription fee will be effective upon your next billing cycle, and will not apply retroactively or to the remainder of your current Arganica Subscription month.

CANCELLATION OF MEMBERSHIP: All Arganica Memberships will be auto-renewed each month. To “opt-out” of this process, you are required to call the customer service line at 434.979.0480 and notify someone from our team who can manually close your membership. Cancellation of membership will take effect immediately. Partial months will not be refunded or reimbursed. If you “opt-out” of membership within five (5) days of your billing date, you will be refunded for that month’s payment. You should allow up to three (3) days for a refund to be fully processed. If after five (5) days, your account will be cancelled but you will be charged for the full month’s membership. You can re-activate your membership at any time by calling the customer service line at 434.979.0480.

MEMBERSHIP PROMOTIONS: All current and past valid promotional codes may be applied to your membership at any time. If the promotion code provides a lower rate than currently billed, the new lower promotional rates (temporary and permanent), whatever is lowest, will be applied to your next billing cycle.

TRANSFER OF MEMBERSHIP: You may not transfer your Arganica Membership, or share your Arganica Membership account with any third party. You may only use your Arganica Membership and the Arganica service for personal, non-commercial purposes.

SOFTWARE REQUIREMENTS: You are solely responsible for ensuring that you have the appropriate software, hardware, and Internet connection necessary to operate the Arganica membership and ordering systems. You may also be required to download additional third party software. Arganica reserves the right to cease supporting any hardware or software platform at any time, with or without notice to you.

FREE-TRIAL PROMOTION: From time to time, Arganica may, in its sole discretion, offer a one-time, free trial to first-time Arganica members ("Free Trial"), which provides members with the benefits of an Arganica Membership for no charge during the designated Free Trial period. The length of any Free Trial period may vary. In order to participate in a Free Trial, you must be a registered Arganica.com user. Unless otherwise stated in the applicable Free Trial offer, if you are a current Arganica member or have previously participated in a Free Trial, you are not eligible to receive a Free Trial. During the Free Trial, you will receive the benefits of an Arganica Membership for no charge. Prior to or upon expiration of the Free Trial period, Arganica may require a credit card authorization for product/deposit billing (see Arganica Deposit System). After the Free Trial period has ended, your authorized credit card will be automatically billed for the membership fee and your membership will be extended until you “opt-out” by calling our customer service line at 434.979.0480.

COMMUNICATION: When you visit www.arganica.com or send e-mails to us (to info@arganica, billing@arganica or marketing@arganica.com) you are communicating with us electronically. In so doing, you consent to receive communications from us electronically. We will communicate with you by e-mail or by posting notices on this site. You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing. You can contact a live person or answering machine anytime at 434.979.0480. We will try to contact you within 24 hours.

CANCELLING AN ORDER: If you placed an order that you wish to cancel for any reason, please call the customer service line at 434.979.0480 to inform us. Orders cancelled with MORE THAN 36-hour notice from delivery time will not be charged, however there will be a charge of $15 for orders cancelled with less than 36-hour notice.

PRIVACY: Due to the nature of the services we provide, Arganica has a need to collect and store certain personal information about our customers. We are fully committed to our customers' personal privacy, and we have developed this privacy policy to clarify our procedures for the collection, use, disclosure, transfer, and storage of your information. To ensure the security of your personal information, we communicate our privacy and security guidelines to our employees and strictly enforce privacy safeguards within the company.
What information do we collect?
When you sign up for an Arganica membership, place an order, subscribe to our newsletter, respond to a survey, or fill out a form, we will ask for information from you. When you sign up for an Arganica membership and create your Arganica account on our website, you will be asked to enter your name, e-mail address, home or work address as required for delivery, phone number, and your credit card information and billing address. You may, however, visit certain sections of our site without creating an account.
What do we use your information for?
Any of the information we collect from you may be used in one of the following ways:

To personalize your experience: The information you provide helps us respond to your individual needs, keep you posted about relevant Arganica announcements and events, and tailor our content and advertising to your interests. We make opting in and out of receiving our mailings easy and accessible. If at any time you would like to unsubscribe from receiving future emails, we include detailed unsubscribe instructions at the bottom of each email.

To improve customer service: Your information helps us to more effectively respond to your customer service requests and support needs. Your accurate contact information allows us to contact you with time-sensitive questions regarding your orders and deliveries.

To process transactions: In order to process purchases and membership payments, we need your billing information. The email address you provide for order processing may be used to send you information and updates pertaining to your order.
For Promotions: We may also use personal information you provide to administer a contest, promotion, survey, or other site feature. Our site may also collect non-personal data—data that does not provide any direct association with a specific person—which we can gather generally from traffic on our website in order to better understand user interest in certain parts, products, services and advertising that appear on our website.
Your information, whether public or private, will not be sold, exchanged, transferred, or given to any other company for any reason whatsoever, without your consent, other than for the express purpose of delivering the purchased product or service requested.
Data Security Technologies, Cookies, Data Collection
Arganica has in place a variety of security measures to maintain the safety of your personal information when you place an order or enter, submit, or access your personal information.
On all pages of our site where we collect personal information, we utilize a secure server. All supplied sensitive/credit information is transmitted via Secure Socket Layer (SSL) technology and then encrypted into our Payment Gateway Provider's database. This information is only accessible to those authorized with special access rights to such systems and who are required to keep the information confidential.
After a transaction, the private information you provide (credit card number, other financial information, etc.) will not be stored on our servers.
Arganica uses cookies—small files that our site or its service provider transfers to your computer's hard drive through your Web browser (unless your browser is configured to block cookies)—to enable our site or service provider's system to recognize your browser and capture and remember certain information.
We use cookies to help us remember and process the items in your shopping cart, understand and save your preferences for future visits, keep track of advertisements and compile aggregate data about site traffic and site interaction so that we can offer better site experiences and tools in the future. We may contract with third-party service providers to assist us in better understanding our site visitors. These service providers are not permitted to use the information collected on our behalf except to help us conduct and improve our business.
Disclosure to outside parties
Arganica does not sell, trade, or otherwise transfer to outside parties your personally identifiable information. This does not include trusted third parties who assist us in operating our website, conducting our business, or servicing you, so long as those parties agree to keep this information confidential. We may also release your information when we believe release is appropriate to comply with the law, enforce our site policies, or protect ours or others' rights, property, or safety. However, non-personally identifiable visitor information (e.g. website traffic data, generalized user preferences) may be provided to other parties for marketing, advertising, or other uses.
Third party links
Occasionally, at our discretion, we may include or offer third party products or services on our website. These third party sites have separate and independent privacy policies. We therefore take no responsibility or liability for the content and activities of these linked sites. Nonetheless, we seek to protect the integrity of our site and welcome any feedback about these sites.
California Online Privacy Protection Act Compliance
Because we value your privacy, we have taken the necessary precautions to be in compliance with the California Online Privacy Protection Act. We therefore will not distribute your personal information to outside parties without your consent. As part of the California Online Privacy Protection Act, all users of our site may make any changes to their information at any time by logging in and going to the appropriate preference in your profile page.
Children's Online Privacy Protection Act Compliance
We are in compliance with the requirements of COPPA (Children's Online Privacy Protection Act), and we do not collect any information from anyone under 13 years of age. Our website, products, and services are all directed to people who are at least 13 years old or older. If we discover that one of our users is under 13 years of age, we will delete that information as soon as possible upon becoming aware that it exists.
HEALTH CONCERNS AND ALLERGIES:
Because Arganica sources foods from many suppliers, Arganica accepts no responsibility for the veracity of claims regarding the practices and/or ingredients as provided to Arganica from these sources. Arganica attempts to provide as accurate and as full information as we can so you may make better informed decisions and food choices. Like shopping at a grocery store or farmers market, all purchases are made at your own risk.
RETURNABLE POLICY:
What are Returnables? - Arganica believes that using returnable and reusable packaging is a smart and easy way to reduce waste and help protect our environment. That’s why we have built a system for the home delivery of food and beverages that integrates the use of returnable packaging and containers as much as possible. Our returnables system requires the active participation of all members. But don’t worry it’s easy! By joining Arganica, you agree to participate in our returnables system. Here’s how it works:
The Basics: The Arganica returnables system requires a small, refundable security deposit for returnable and reusable packaging, as follows:
Crate Liners: All food and beverage orders are packed inside a returnable crate liner. Made of insulated cardboard or other materials, returnable crate liners make packing more efficient. Crate liners require a $2.10 refundable deposit on every order. Credit for returned Crate Liners is applied to your subsequent order. Please note that we accept all empty crate liners, regardless of the condition they are in. Broken bottles will not be accepted.
Gel packs: To help keep food fresh and beverages chilled during delivery, we add frozen gel packs to your food order. Gel packs require a $.50 refundable deposit each on every order. We estimate 4 Gel Packs are needed to ensure proper temperatures in each order, but are used at the discretion of our team when fulfilling the order, depending on the size and contents. Credit for returned Gel packs is applied to your subsequent order.
Bottles & other reusable containers: Our returnable system also includes milk, oil, and seltzer bottles, and other containers made of glass or other reusable materials. If a refundable deposit is required for a food/beverage item, the amount is indicated on the weekly packing slip. All returned bottles must be rinsed clean!
Membership Termination
On your final delivery, you may elect to keep the returnables and forgo your final returnables deposit. The Gel Packs can be used for any picnic—they are biodegradable and food safe. Please recycle the crate liner.
By agreeing to an Arganica membership and delivery of returnables, the customer agrees to return these items at the “earliest possible opportunity”, preferably during the customer's next scheduled delivery cycle or within one month following termination of membership.
Without explicit approval from Arganica, no credit will be provided for items not returned within four delivery cycles (approximately 30 days).
All items used in the Arganica returnables system are the property of Arganica or its suppliers and Arganica considers the customer as “custodian” of the delivery vessel until such vessel is returned to Arganica.
